On the morning of November 2, the National Assembly discussed the draft Law on Consumer Rights Protection (amended). Commenting on the Law project, according to delegate Ly Tiet Hanh (Doan Binh Dinh), counterfeit goods mean imitations of famous brands. Buying and selling counterfeit goods is very popular with both buyers and sellers.
The Binh Dinh delegation said that when the seller of fake goods was discovered, there was a law to handle it. However, is it a violation for consumers to intentionally use counterfeit goods? According to the female delegate, this bill has not mentioned the above case.
Delegate Ly Tiet Hanh (Binh Dinh union) said that if people who intentionally buy fake goods are not handled, they will not be able to protect consumers in a sustainable way.
“The fact that there are many well-known brands that are openly sold counterfeit and used by consumers in an impartial manner, the law is not clear in this regard. Therefore, to protect consumers in a sustainable way needs justice equal in this matter with both the seller and the buyer” Ms. Hanh emphasized.
The Binh Dinh delegation said that if the responsibility of consumers is not improved, it is often confused, and in the end, many people will have to spend real money to buy fake goods.
Strictly handle artists who advertise panacea
Contributing to the draft Law, delegate Do Huy Khanh (Dong Nai delegation) contributed to Article 15 on “Consumers’ rights”.
According to the delegate, we need to protect consumers in terms of quality and price. Because, we have to buy the “heavenly” price, when the supplier offers a product but does not know the actual price, so consumers are easily deceived.
In Article 14, part 4, it is stated that “Consumers are allowed to give opinions to business organizations on prices”, according to delegates, it is very difficult to give opinions and should be replaced with the phrase “providing value” of the product” would be appropriate.
Delegate Do Huy Khanh also commented in Article 18 on “handling violations of the law on consumer protection”.
Mr. Khanh said that this idea is very general and that should we clarified or not. Because in fact, when consumers buy poor-quality products, there should be strong sanctions.
In particular, he emphasized: “Recently, there are many cases related to functional foods and medicines that can cure all diseases that are advertised and sold by famous artists on the Internet. However, when the authorities investigate, these products have no such function. The artist’s reputation is affected and just apologizing is done, as if nothing happened.”
Since then, the Dong Nai delegation has wondered how to handle those artists so that it doesn’t happen again. At the same time, it is also necessary to review those advertising companies and businesses. “Article 18 on handling violations of the consumer protection law has 3 criteria but is very general, so how to supplement and how to make it clearer” delegate Do Huy Khanh suggested.
Giving opinions on consumer protection rights, National Assembly Representative Truong Xuan Cu (Hanoi delegation) cares about the elderly.
Regarding services to consumers, delegates said that the draft Law gives a lot of rights and responsibilities, but the most obvious right is the right to be consulted which is not good… without a consultant, consumers do not understand anything, it is very difficult to protect.
Delegate Cu shared that currently the elderly are the most affected by medical products.
“95% of elderly people have 2.9 underlying diseases, so it is difficult to choose current drug products without consulting” the delegate expressed concern.
According to the Hanoi delegation, currently, private companies produce a lot of products, especially products from oriental medicine to western medicine. The image is not clear, so it needs to be clarified.
“I take for example a branded bag worth 200 million, but without careful advice, consumers can buy non-standard goods (for only 4 million but have to buy for several hundred million). Therefore, it is necessary for consumers to be fully consulted about the products they want to buy and have needs” said the delegate.
